Tap & Track – Terms of Use

Welcome to Tap & Track! These Terms of Use ("Terms") govern your use of the Tap & Track mobile application and related services (collectively, the "App"), operated by Trianvil Software d.o.o. ("we," "our," or "us"). By downloading, accessing, or using Tap & Track, you agree to these Terms.
If you do not agree with these Terms, please do not use the App.
1. License Grant
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Tap & Track solely for personal, non-commercial use to support general wellness, nutrition awareness, diet, and fitness tracking. This license does not convey any ownership rights.
2. Restrictions
You agree not to:
Copy, modify, distribute, sell, sublicense, or lease any part of the App;
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code;
Use the App for any unlawful purpose or in violation of any applicable laws or regulations;
Remove, obscure, or alter any copyright, trademark, or proprietary notices.
3. Medical, Wellness & No‑Diagnostic Disclaimer
Tap & Track is designed for informational, educational, and general wellness purposes only. The App does not provide medical advice, diagnosis, or treatment.
Tap & Track is not a medical device under applicable laws and regulations, including U.S. Food and Drug Administration (FDA) regulations, and is not intended to diagnose, treat, cure, mitigate, or prevent any disease or medical condition.
Always consult a qualified healthcare professional before making changes to your diet, supplementation, exercise routine, or medication. The App is not intended for medical decision-making, nor for use by pregnant individuals or those under 18 years of age without appropriate supervision.
By using the App, you acknowledge that dietary and fitness activities involve inherent risks and that you assume full responsibility for those risks.
4. Limitations of AI‑Generated Information
You acknowledge and agree that the App utilises Large Language Models and other AI‑based technologies to interpret, estimate, summarise, and classify nutritional data.
AI systems are inherently probabilistic and may produce inaccurate, incomplete, or incorrect outputs, including but not limited to incorrect nutrient values, calculations, classifications, or interpretations (commonly referred to as "AI hallucinations").
Tap & Track makes no representation or warranty regarding the accuracy, reliability, or completeness of AI‑generated nutritional insights.
You agree to independently verify all nutritional information using official food labels, manufacturer disclosures, or qualified medical or nutritional professionals before making dietary or lifestyle decisions.
5. Nutritional Data Sources and Accuracy
Nutritional values, benchmarks, reference ranges, and comparative thresholds used by the App are derived from publicly available third‑party databases and licensed data providers, including but not limited to governmental and public‑health nutritional datasets.
These sources may include, without limitation, databases maintained by authorities such as USDA FoodData Central and UK Public Health England / NHS reference values.
Tap & Track does not independently verify, audit, or guarantee the accuracy, completeness, timeliness, or consistency of third‑party nutritional data.
Displayed values are estimates only and may vary due to regional differences, food preparation methods, ingredient sourcing, manufacturing changes, database updates, or user input inaccuracies.
6. Subscriptions and Billing
Tap & Track offers optional auto‑renewable subscriptions for access to premium features. Subscription details, including pricing and duration, are displayed within the App prior to purchase.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
You may manage or cancel subscriptions at any time through your App Store account settings.
Payments are charged to your Apple ID account upon confirmation of purchase. Any unused portion of a free trial is forfeited upon subscription purchase.
7. Termination
We reserve the right to suspend or terminate your access to the App at any time, without notice, if you violate these Terms or engage in fraudulent, abusive, or unlawful use.
Upon termination, all rights granted under these Terms will immediately cease.
8. Ownership and Intellectual Property
All content, software, trademarks, and intellectual property within Tap & Track are owned by or licensed to Trianvil Software d.o.o. and are protected under applicable intellectual‑property laws.
No rights or ownership are transferred to you except as expressly granted in these Terms.
9. Limitation of Liability
To the maximum extent permitted by law, Trianvil Software d.o.o. shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the App.
Our total aggregate liability for all claims shall not exceed the amount paid by you for your Tap & Track subscription, if any, during the twelve (12) months preceding the claim.
12. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal data.
10. Changes to These Terms
We may update these Terms from time to time. The most current version will always be available at https://www.trianvil.com/terms-of-use.
Your continued use of the App after changes are published constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws applicable in your country of residence, without regard to conflict‑of‑law principles.
